Food Fitness Privacy Policy
This policy (hereinafter, the “Policy”) covers how Food Fitness International, Inc. d/b/a Food Fitness. The policy considers personal information that Food Fitness collects and receives, including information related to your past use of Food Fitness products and services. Personal information is information about you that specifically identifies you, like your name, address, email address, or phone number, and which is not otherwise publicly available. This policy does not apply to third party practices, including practices of companies that Food Fitness does not own or control, or to people that Food Fitness does not employ or manage. In addition, certain Food Fitness services may have their own associated privacy statements.
Food Fitness International, Inc. d.b.a. Food Fitness (“Food Fitness”), operates this website, lisadorfman.co, and other websites that are part of the Food Fitness’ portfolio of websites, including but not limited to, chienergybites.com and foodfitness.com (collectively, the “Sites”) and the services related to or offered on the Sites (hereinafter, the “Services”). Some of the Sites are websites that we operate on behalf of third-party licensors, for example, chienergy.com (hereinafter collectively, “Licensors”). Food Fitness’s Services may include, without limitation, tools, applications, email services, bulletin and message boards, chat areas, news groups, forums, communities, calendars, and downloadable mobile applications related to, or provided via, the Sites.
The purpose of this Policy is to help you understand the kinds of information we may gather about you when you visit the Site or use any of our Services, how we may use and disclose the information, and how you can control, correct and/or update the information.
To be clear about the terminology we are using, when we use the phrase “Personal Information” in this Policy, we mean information that can be used to identify or contact a person, like a person’s full name, address, e-mail address, or phone number. When we use the phrase “Anonymous Information” in this Policy, we mean information that cannot reasonably be used to identify individual persons.
By visiting this Site or using the Services, you are accepting the policies and practices described in this Policy. Each time you visit the Site or use the Services, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.
Your Personal Information will be processed by us in the United States.
In addition to this general Policy, each Service may have additional privacy provisions that are specific to the particular Service. These supplemental disclosures are made adjacent to the particular Service at the time we collect the information. These supplemental disclosures also govern the use of your information.
1. The Information We Collect
We collect information about you in the following ways:
A. Information you voluntarily provide us.
We collect and maintain information that you voluntarily submit to us during your use of the Sites and Services. For example, but not limited to:
a. When you register for a Site, you may provide us certain information including your name, email address, screen name, password, demographic information and the health topics that interest you;
b. To engage a Site’s social networking function, you may add to your profile by providing information about your interests or health topics. For example, your profile may list your favorite healthy foods or movie;
c. If you are registering for a customized weight loss program, you may provide us answers to questions we use to provide you the program, like your actual and goal weights, your preferred method of exercise, or your caloric intake;
d. If you sign up to receive a newsletter, enter a contest or participate in social networking activities, you may provide us contact information (e.g., email or physical address);
e. If you purchase a product or service, you may provide us your credit card information; and
You may provide us with Personal Information in the course of email, customer support interactions and surveys.
f. You can choose not to provide us with certain information, but this may stop you from gaining access to a Service or limit the features that you can use. For more information, please see the How We Use Your Information section below.
B. Information we collect through your use of the Site.
As you use the Site and Services, certain information may also be passively collected. Through cookies, pixels, beacons, log files and other technologies, we may collect information about how you use the Site and the Services. For example, we may determine through an IP address that a particular computer or device is located in Miami and we may use this information to deliver advertisements promoting Miami-based businesses. This information allows us to deliver more helpful information, programs, tools and advertisements. Please see the Cookies and Targeted Advertising sections below for more information.
C. Information we receive from third parties.
We may also combine online and/or offline information received from third parties with the information we have already collected from you via our Sites and Services. The third-party information is used for a variety of purposes including to verify other information about you (e.g., verify your mailing address to send you requested products or services) and to enhance the content and advertising we provide to you.
2. How We Use Your Information
We will use your Personal Information in the ways described below or described at the time that the information is collected.
A. Advertising.
We believe that advertising is more interesting to you when it is relevant. Accordingly, we customize the advertisements that you see based upon: (i) the information that you provide us (e.g., age, gender, stated health interests and other information in your profile); (ii) geographic location information, which we may determine through your IP address, from your mobile device, or other ways; (iii) data we receive from third parties or; (iv) your visits on the Sites or use of Services (commonly referred to as “Behavioral Advertising”). Please see the Cookies and Targeted Advertising section below for more information on the use of cookies and the information collected for Behavioral Advertising.
B. To Provide the Sites and Services.
In general, we use your Personal Information as necessary or appropriate for purposes including to:
a. Administer your account;
b. Register you and provide you access to the Site or Services;
c. Respond to inquiries or requests that you direct to us;
d. Fulfill your requests for products or services;
e. Send communications and administrative emails about the Sites or Services;
f. Personalize and better tailor the features, performance and support of the Sites and Services for your use;
g. Send you promotional/marketing information, newsletters, offers or other information regarding opportunities and functionality that we think would be of particular interest to you;
h. Improve the quality of the Site and the Services, and
i. Analyze, benchmark and conduct research on user data and user interactions with the Site and Services.
3. Cookies and Targeted Advertising
A. Cookies, Web Beacons and IP Address Information.
“Cookies” are small pieces of information that a website places on your browser when you visit that website. We may use cookies to provide you with a more personal and interactive experience with the Sites and Services. For example, we may use cookies to control what advertisements you see, the sequence of advertisements and to make sure you don’t see the same advertisement too many times. For contests or sweepstakes, we may also use cookies in order to track your progress and the number of entries in some promotions. For polls, we may use cookies to help ensure that an individual can’t vote more than once on a particular question or issue. We do not store Personal Information in any cookies on your computer.
Cookies can be removed by following your Internet browser’s directions within the help tab. In order to use certain Services offered through the Sites, your web browser must accept cookies. If you choose to disable cookies, some aspects of the Sites may not work properly, and you may not be able to access our Services.
We may also use cookies, pixels, web beacons (which are usually small, transparent graphic images), operating system and device information and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit, the features and information for which you searched and viewed, the email you opened, or on which advertisements you clicked. This type of information is collected to make the Sites and Services more useful to you and to tailor the experience with us to meet your special interests and needs.
An “Internet protocol address” or “IP Address” is a number that is automatically assigned to your computer when you use the Internet. We, or our service providers, may use your IP Address when you access the Sites or Services or use other means to assist with delivering geographically targeted advertisements.
B. Targeted Advertising.
Companies Food Fitness works with may use cookies for purposes including understanding Web usage patterns of users who see advertisements on the Sites, controlling the sequence of advertisements you see, making sure you don’t see the same advertisement too many times, determining your interests and tailoring advertisements and promotions based on those interests. For example, if you read an article about a particular health condition on the Sites, we may use cookies from a vendor to later serve you an advertisement for a product related to the viewed article. These third-party vendors may connect information about pages you visit on our Sites with information about pages you visit on other websites and show you advertising based on this combined information. The advertisement may appear when you are visiting a different section of this Site, another Site or any other website on the Internet if the website also has a relationship with our vendor.
C. Information Collected by Third Party Advertisers
Advertisers or other third parties on the Sites may also engage in Behavioral Advertising and use cookies and web beacons in the manner described above. We do not control these advertisers or other parties’ use of cookies or web beacons or what they do with the information they collect. Many third-party vendors that engage in Behavioral Advertising participate in the Network Advertising Initiative (NAI) and/or the Digital Advertising Alliance (DAA) and abide by NAI and/or DAA principles. If you wish to opt out of participating in advertising programs conducted by NAI and DAA members or learn more about the NAI and DAA, please go to the NAI Opt-Out website and DAA Choice Page and follow the instructions. After you opt-out, you will still see advertisements, but the advertising may not be as relevant to your interests. If you change your computer, change your browser or delete your cookies, you will need to renew your opt-out.
4. How We Disclose Information to Third Parties
We may share your Personal Information with third parties as specifically approved by you or under the circumstances described below. If you do not want us to use or disclose Personal Information collected about you in the ways identified in this Policy, you should not use the Site or Services.
A. Disclosure for legal reasons.
We may disclose and release your Personal Information to third parties: (a) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (b) in special cases, such as a physical threat to you or others, a threat to homeland security, a threat to our system or network, or in any cases in which we believe it is reasonably necessary to investigate or prevent harm, fraud, abuse, illegal conduct or a violation or alleged violation of this Policy or other agreement we may have with you.
B. Agents and Contractors.
We may provide your Personal Information to service providers who work on our behalf or help us to operate our business, the Sites and the Services. Examples of such service providers include vendors and suppliers that provide us with technology, services, and/or content for sending email, analyzing data, research, providing advertising and marketing assistance, processing payments (including credit card payments), and providing customer service. Access to your Personal Information by these service providers is limited to the information reasonably necessary to perform its limited function.
C. Aggregated, Anonymous Information.
We may share aggregated Anonymous Information about you with third parties. Aggregated information is your Anonymous Information that is combined with the Anonymous Information of other users.
D. Contests, sweepstakes and polls.
Some or all of the information collected during a promotions, contest, polls, or sweepstakes (“Promotions”) may be disclosed publicly. It may also be shared with other third parties as disclosed at the time of collection or in the Promotion rules. These third parties may include providers of prizes in order to update you of your status of your prize or other fulfillment needs or a co-sponsor who may use your Personal Information to administer the Promotion or for their marketing purposes, but only in conformance with their privacy policy as made available to you at the time of collection. Food Fitness is not responsible for their privacy policy or practices.
When you participate in a Promotion, you are subject to any official rules for that Promotion, which may contain additional information about the specific privacy practices associated with the Promotion.
E. Long-Term-License Services.
Some of the Sites are websites that Food Fitness operates on behalf of Licensors. Food Fitness may share some or all of your Personal Information with its Licensors. This Policy does not cover the use of your Personal Information by Licensors. The privacy practices of Food Fitness’s Licensors may differ from this policy, and we encourage you to contact those third parties directly if you have questions regarding their use of your Personal Information.
F. Sponsors, Merchants and other ways that you approve at the time of collection.
We may collect Personal Information about you and share it with third parties to the extent that you give us permission at the time of collection. For example, if you purchase a deal or service, we will provide your information to the applicable merchant or vendor. We also sometimes gather Personal Information on behalf of a sponsor in association with a promotion. In such a case, we will provide you notice at the time of collection that the information is being collected on the sponsor’s behalf and link to the sponsor’s privacy policy.
G. Within our Company; Changes to our Company.
We may share your Personal Information with any of our subsidiaries, joint ventures, or other companies under common control. Additionally, in the event we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Policy.

THIS PRIVACY POLICY AND HIPAA NOTICE OF PRIVACY PRACTICES (“PRIVACY POLICY”) DESCRIBES HOW YOUR HEALTH INFORMATION MAY BE USED AND DISCLOSED. PLEASE REVIEW IT CAREFULLY.

Purpose
Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND and Food Fitness International, Inc. are committed to protecting the privacy of your personal information, laboratory test results, and other protected health information. This Privacy Policy applies to all users of, as well as employees, management and contractors, of Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND and Food Fitness International, Inc.
Our Privacy Obligations
We are required by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) to maintain the privacy of patients’ health information (“Protected Health Information”) and to provide our patients with this Privacy Policy, outlining our legal duties and privacy practices with respect to their Protected Health Information. Users of the Website and patients are referred to as “you” or “your” throughout this Privacy Policy. Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND, Food Fitness International, Inc. and their workforce are referred to as “we”.
Responsibilities of Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND, Food Fitness International, Inc.
Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND has established this Privacy Policy, including implementing and maintaining the various policies and procedures described herein, as an overall program in accordance with HIPAA guidelines.
Use and Disclosure of Health Information
Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND is permitted by federal privacy law to use and disclose our Protected Health Information for treatment, payment, healthcare operations, and other purposes permitted or required by law. Protected Health Information is the information we create and obtain in providing our services to you, including billing documents related to the services we provide to you.
We may use and disclose your Protected Health Information for the following purposes:
Treatment. We may use or disclose your Protected Health Information for treatment purposes. For example, we may use your Protected Health Information to perform our testing services and disclose your Protected Health Information, including laboratory test results, to physicians and other health care providers involved in your care.
Payment. We may use or disclose your Protected Health Information to obtain payment for health care services we provide. For example, we may disclose your information to your health plan to receive payment for the services provided to you.
Health Care Operations. We may use and disclose your Protected Health Information for our health care operations. These activities include, for example, monitoring the quality of our testing services, reviewing the competence or qualifications of laboratory professionals, conducting training programs, performing accreditation, certification, licensing and credentialing activities, and other business and administrative functions.
Personal Representatives; Minors; Persons Involved in Your Care or Payment for Your Care. We may disclose Protected Health Information about you to your authorized personal representative, as defined by applicable law, or to an administrator, executor, or other authorized person responsible for your estate. As permitted by federal and state law, we may disclose Protected Health Information about minors to their parents or guardians. We may disclose your Protected Health Information to a person involved in your care or payment for your care, such as a family member or close friend, as designated by you or as we identify using our best efforts. We may use or disclose your Protected Health Information for disaster relief efforts or to notify a family member or close friend of your location or general condition. If you do not want us to use or disclose your Protected Health Information in these ways, you must notify us using the contact information at the end of this Privacy Policy.
Communications About Our Products and Services. We may use and disclose your Protected Health Information to contact you about our products and services which we believe may be of interest to you.
As Required by Law. We must disclose your Protected Health Information when required to do so by any applicable federal, state or local law. For example, we are required to report child abuse or neglect and must provide certain information to law enforcement officials in domestic violence cases.
Health Oversight Activities. We may disclose your Protected Health Information to a health care oversight agency for activities that are authorized by law, such as audits, investigations, inspections, and licensure activities. For example, we may disclose your Protected Health Information to agencies responsible for ensuring compliance with the rules of government health programs such as Medicare or Medicaid.
Research. Under certain conditions, such as following review by an institutional review board, we may use or disclose Protected Health Information for research purposes. We may allow researchers to look at Protected Health Information to develop a study, identify prospective research participants, or for similar purposes provided that the information is not removed from our premises.
Disclosures to Business Associates. We may disclose your Protected Health Information to other companies or individuals, known as “business associates,” who need your information to provide services to us. For example, we may use another company to perform billing services on our behalf. We will disclose your Protected Health Information only after a business associate has agreed in writing to safeguard that information. Our business associates also are required by law to protect the privacy of your Protected Health Information.
Judicial and Administrative Proceedings. Under certain circumstances, we may disclose your Protected Health Information in the course of a judicial or administrative proceeding in response to a court order, subpoena, or other lawful process.
Fundraising. We may use certain information to contact you about fundraising efforts on our behalf. If you receive such a fundraising communication, you will be provided an opportunity to opt-out of receiving such communications in the future.
Law Enforcement; Threats to Health or Safety. We may disclose your Protected Health Information to the police or other law enforcement officials as required by law or in compliance with a court order, warrant, subpoena, summons, or similar process authorized by law. Under certain circumstances, we also may disclose Protected Health Information to law enforcement officials when the information is needed to: identify or locate a missing person or a suspect, fugitive, or material witness; determine whether an individual has been a victim of a crime; determine if a death resulted from criminal conduct; or investigate suspected criminal activity on our premises. We may also disclose Protected Health Information if necessary to prevent or reduce the risk of a serious and imminent threat to the health or safety of an individual or the general public.
Workers Compensation. If you seek compensation for a work-related illness or injury, we may disclose your Protected Health Information as necessary to comply with requirements of workers’ compensation or similar programs that provide benefits for work-related injuries or illness without regard to fault.
All Other Uses and Disclosures of Protected Health Information. We will ask for your written authorization before using or disclosing your Protected Health Information for any purpose not described above. Specific examples of such types of uses include (1) most uses of your health information for marketing purposes and (ii) disclosures of your health information that constitute the sale of your health information. You may revoke your authorization, in writing, at any time, except that a revocation will not affect any use or disclosures we have made in reliance on your authorization.
Disaster Relief: We may use and disclose your health information to assist disaster relief efforts
Food and Drug Administration (FDA): We may disclose to the FDA health information relative to adverse events with respect to food, supplements, product or product defects, or post-marketing surveillance information to enable product recalls, repairs or replacement.
Coroners, Medical Examiners and Funeral Directors: We may disclose health information consistent with applicable law concerning deceased patients to coroners, medical examiners and funeral directors to assist them in carrying out their duties.
Organ and Tissue Donation: We may disclose health information consistent with applicable law to organizations that handle organ, eye or tissue donation or transplantation.
19. Military, Veterans, National Security and Other Government Purposes: If you are a member of the armed forces, we may release your health information as required by military command authorities or to the Department of Veterans Affairs. We may also disclose medical information to authorized federal officials for intelligence and national security purposes.
Correctional Institutions: If you are an inmate, we may disclose information necessary for your health and the health and safety of other individuals in the institution or its agents.
Your Rights
The health and billing records we maintain are the physical property of Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND , MD. The information in those records, however, belongs to you. You have the following rights with respect to your Protected Health Information. To exercise any of these rights, please contact us.
Access to Protected Health Information. You or your authorized or designated personal representative have the right to inspect and copy your Protected Health Information and billing information maintained by us. We may deny access to certain information for specific reasons, for example, where state law prohibits such patient access. Health information that is maintained electronically may be accessed in an electronic format. We may assess a reasonable, cost-based fee for production of records. Please note that federal and state laws regulating laboratories generally prohibit us from disclosing test results directly to a patient. PLEASE NOTE THAT FEDERAL AND STATE LAWS REGULATING LABORATORIES GENERALLY PROHIBIT US FROM DISCLOSING TEST RESULTS DIRECTLY TO A PATIENT.
Restrictions on Uses and Disclosures. You have the right to request restrictions on our use and disclosure of your Protected Health Information. While we will consider all requests for additional restrictions carefully, we are not required to agree to a requested restriction. If we do agree to a requested restriction, we will notify you in writing. If you have paid for services out-of-pocket in full, you may request that we not disclose information related solely to those services to your health plan.
Confidential Communications. You have the right to request that we communicate with you about your Protected Health Information by alternative means or to an alternative address. Your request must be in writing and must specify the alternative means or location.
Correct or Update Information. If you believe the Protected Health Information or billing information we maintain about you contains an error, you may request that we correct or update your information. Your request must be in writing and must explain why the information should be corrected or updated. We may deny your request under certain circumstances, if the information (i) was not created by us; (ii) is not part of the health information kept or for Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND; (iii) is not part of the information that you would be permitted to inspect or copy; or (iv) is accurate and complete. If your request is denied, you will be informed of the reason for the denial and will have an opportunity to submit a statement of disagreement to be maintained with your records.
Accounting of Disclosures. You may request in writing a list, or accounting, of certain disclosures of your Protected Health Information made by us or our business associates for purposes other than treatment, payment, healthcare operations, and certain other activities. The first list will be provided to you for free, but you may be charged for any additional lists requested during the same year.
Our Responsibilities

Maintain the privacy of your health information as required by law.
Provide you with a notice as to our duties and privacy practices as to the information we collect and maintain about you.
Abide by the terms of this notice.
Notify you if we cannot accommodate a requested restriction or request.
Notify you following a breach of your health information that is not secured in accordance with certain security standards.
We reserve the right to change the terms of this notice and to make the provisions of the new notice effective for all health information that we maintain. If we change the terms of this notice, the revised notice will be made available upon request, posted to our website, and will be effective for all Protected Health Information we maintain, including information created or received prior to implementation of the new notice.
Health Care Providers Covered by This Notice
This notice applies to Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND and her personnel, volunteers, students and trainees. These health care providers will follow this notice for information they receive about you from Lisa Dorfman, MS, RD, CSSD, CCMS, LMHC, FAND, but these providers may follow different practices at their own offices of facilities.
6. Message Boards and Chats
We may make message boards, chat rooms, and other interactive forums available as part of the Services. You should be aware that any information which you post to these interactive forums or otherwise choose to make publicly available, including your Personal Information, may be disclosed and available to all users who have access to that portion of the Site or Services. By using these interactive forums, you agree that we are not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk.
7. Children’s Information
The Site and Services are not directed or intended for children under 13 years of age. We do not knowingly collect Personal Information from individuals under 13 years of age. If you are under 13 years of age, you should not register or provide Personal Information on the Site or through the Services. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to us, please contact us at info@lisadorfman.co so that we may delete and remove such child’s information from our systems.
8. Updating and Control of Your Personal Information
We offer you choices regarding the collection, use, and sharing of your Personal Information. When you receive promotional communications from us you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the promotional e-mail or newsletter you receive or by editing your preference to receive these communications within the “Manage My Email” or similar feature on the individual Sites when you are logged in as a registered user.
If your Personal Information changes or if you no longer desire to use or access one of the Sites or Services, we encourage you to correct, update or remove the Personal Information from your profile. This can be done at the “Profile” or “My Account” section on each of the Sites. Keep in mind, however, that even if you delete information from your profile, we may retain your Personal Information in conformance with our data retention policy and Personal Information may remain within our databases, access logs, and other records. In addition, we are not responsible for updating or removing your Personal Information contained in the lists or databases of third parties who have been provided information as permitted by this Policy.
9. Co-branded Sections of the Sites
Certain portions of the Sites may be co-branded with a business partner and subject to a different privacy policy that is either the partner’s privacy policy or a privacy policy developed jointly by Food Fitness and our partner (collectively the “Co-branded Policy”). The partner’s collection, use and dissemination practices regarding any data or Personal Information provided by, or obtained from users of these Co-branded portions of the Sites will be governed by the Co-branded Policy. Please read the Co-branded Policy for each Co-branded Site before providing any Personal Information.
10. Third Party Links
The Sites may link to websites operated by third parties that we do not control. We do not monitor, control, or endorse the information collection or privacy practices of any third parties. We encourage you to become familiar with the privacy practices of every website you visit and to contact them if you have any questions about their respective privacy policies and practices. This Policy applies solely to information collected by us through the Sites or Services and does not apply to these third-party websites. The ability to access information of third parties from the Sites or Services, or links to other websites or locations, is for your convenience only and does not signify our endorsement of such third parties, their products, services, websites, locations or their content.
11. Security
We place a priority on the security of Personal Information, and we undertake reasonable security measures to help protect the data that resides on our servers. We also use secure server software (SSL) to process all financial transactions that occur on the Site. SSL technology can encrypt Personal Information transmitted over the Internet. However, no security system is impenetrable. We do not warrant the security of our servers, nor do we warrant that your information, including Personal Information, will be completely secure or not be intercepted while being transmitted over the Internet.

13. Privacy Policy Changes
